Referral Partner Programme T&Cs

This Agreement outlines the terms and conditions under which Host & Stay will pay the Referrer a commission for successful referrals of holiday let owners who sign up and open a property calendar with Host & Stay.

Referral commission agreement

This Referral Commission Agreement (the “Agreement”) is entered into on the effective date specified below by and between Host & Stay (“Company”) and [Referrer’s Full Legal Name] (“Referrer”), collectively referred to as the “Parties.”.

1. Referral Commission Fees

The commission fees payable by Host & Stay to the Referrer for each successfully signedup holiday let owner, as well as the payment schedule, are defined as follows:

Full Payment: Paid one month after the referred property’s calendar is opened with Host & Stay.

2. Commission Fee Schedule

The commission fee structure is detailed based on the number of properties, property size, and property type.

A. Individual Property Commission

For each individual property referred (up to a maximum of 5 properties), the Referrer shall receive a commission based on the number of bedrooms as follows:

• 1-Bedroom Property: £250
• 2-Bedroom Property: £450
• 3-Bedroom Property: £750
• 4-Bedroom Property: £1,250
• 5+ Bedroom Property: £1,500

B. Block/Same Site Property Commission

5-20 Units = £1,250

3. Cancellations and Adjustments

In the event that a property owner introduced to us by a referrer terminates their agreement with us within six (6) months of commencement, and we reasonably determine that there is a recurring pattern of early terminations among properties referred by the same referrer, we reserve the right, at our sole discretion, to:
• terminate our agreement with the referrer; and
• refuse to accept any further referrals from that referrer.

4. Payment Terms

Payments to the Referrer will be made via Bank Transfer within 60 days. The referrer is responsible for providing accurate payment details via an invoice. Host & Stay is not liable for payment errors due to incorrect details provided by the Referrer.

5. Independent Contractor Relationship

This Agreement does not create an employment, partnership, or joint venture relationship between Host & Stay and the Referrer. The Referrer shall act as an independent contractor for all purposes related to this Agreement.

6. Entire Agreement

This Agreement constitutes the entire understanding between the Parties regarding referral commissions and supersedes all prior discussions, agreements, or understandings of any kind.

7. Amendment and Termination

This Agreement may only be amended in writing and signed by both Parties. Either Party may terminate this Agreement with 30 days written notice to the other Party, provided any outstanding referral commissions due to the Referrer will be paid per the terms of this Agreement.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Effective Date: 31/10/2024.
